Residential Trash Service Agreement
This Residential Trash Service Agreement (the “Agreement”) is made and entered into by and between ROSE ROLL OFF LLC, dba ROSE DISPOSAL INC. a Texas Limited Liability Company (the “Provider”), and Customer, an individual (the “Resident”).
1. Service Description: The Provider agrees to furnish weekly residential trash collection services to the Resident at the service address listed on the invoice. This
service includes the pickup of household waste placed in the designated trash cart(s) provided by the Provider.
2. Term of Agreement: This Agreement shall commence on April 30, 2025, and shall remain in effect on a quarterly basis unless terminated by either party with at least 30 days’ written notice.
3. Trash Cart Delivery & Ownership: The Provider will deliver one (1) trash cart to the Resident’s service address. The cart remains the property of the Provider. Additional carts may be requested at an additional charge.
4. Service Schedule & Guidelines
● Trash collection will occur once per week on the assigned service day.
● All trash must be bagged and placed inside the provided cart by 5:00 AM on the scheduled pickup day.
● The Resident is responsible for placing the cart at the curb or designated pickup location.
● Overfilled carts or additional waste placed outside the cart will be subject to additional fees.
5. Fees & Payment
● The Resident agrees to pay a quarterly service fee of $96, plus tax, due on the 1st of each quarter.
● Late payments will incur a 10% late fee per week.
● The Provider reserves the right to suspend service for unpaid balances exceeding 30 days.
6. Additional Charges The Resident may incur additional charges as follows:
● Additional trash cart rental: up to $39 per quarter
● Extra bags or waste outside of the cart: $5 per bag at the driver’s discretion
● Missed pickup due to blocked access or improper placement: $25
● Return trip for missed pickup: $35
● Overfilled cart (carts lid must be closed): $15 per occurrence
● No large item pickup (e.g., furniture, appliances)
● Hazardous materials, tires, or prohibited waste: $250 per violation
7. Resident Responsibilities
● The Resident agrees to maintain the cart in a clean and sanitary condition.
● The Resident shall not place hazardous materials, construction debris, or prohibited waste in the cart.
● The Resident is responsible for damages to the cart beyond normal wear and tear.
8. Provider’s Rights & Termination
● The Provider reserves the right to modify service terms with 30 days’ notice.
● The Provider may suspend or terminate service for non-payment or repeated violations of service guidelines.
9. Limitation of Liability
The Provider shall not be responsible for damages to driveways, lawns, or other property due to normal waste collection operations. The Resident agrees to indemnify the Provider against any claims arising from improper waste disposal.
10. Governing Law: This Agreement shall be governed by the laws of the State of Texas.
